Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets out the rules for using JIVIQ ("JIVIQ", "we", "us", "our") and everything we operate — the admin application, public booking pages, the embedded chat widget, forms hosted on forms.jiviq.com, the jiviq.com website, our APIs and webhooks, and any related features (together, the "Service"). The Service is operated by Stratus Labs (registered address: C4 602, Edenn Towers CHS, Pune 411057, India). This AUP works alongside our Terms of Service and our Privacy Policy; where it overlaps with the Terms, both apply. By using the Service you agree to follow this AUP.

1. Scope

This AUP applies to everyone who uses any part of the Service. That includes:

  • Account holders — the professionals, business owners, and team members who sign up for and use JIVIQ.
  • Anyone using a JIVIQ surface — people who interact with a booking page, the chat widget, or a form, whether or not they have an account.

If you let other people use the Service through your account, you are responsible for making sure they follow this AUP.

2. Permitted use

JIVIQ is built to help you run a legitimate business — take bookings, talk to your customers through the chat widget, collect form responses, manage customer records, gather feedback, and use the AI assistant to work faster. You may use the Service for these ordinary, lawful business purposes, within the limits of your plan and these policies.

3. Prohibited uses

You must not use the Service — or allow anyone else to use it through you — to:

  • Break the law — engage in, promote, or facilitate any illegal activity, or violate any applicable law or regulation.
  • Deceive or defraud — commit fraud, run phishing or other deceptive schemes, send spam or unsolicited bulk messages, or impersonate any person, business, or organisation (including impersonating JIVIQ).
  • Distribute harmful or abusive content — publish, transmit, or store content that is harmful, abusive, defamatory, obscene, or otherwise objectionable.
  • Harass or threaten — harass, bully, threaten, stalk, or intimidate any person, or incite violence against anyone.
  • Spread malware — upload, link to, or transmit viruses, worms, ransomware, or any other malicious code.
  • Infringe intellectual property — use, copy, or distribute content, trademarks, or other material in a way that infringes someone else's intellectual-property or other rights.
  • Upload unlawful or infringing files — attach or upload, through chat, forms, or any other feature, files that are unlawful, infringing, or that you do not have the right to share.
  • Collect data unlawfully — gather, store, or process personal data you have no lawful basis to handle, or that you obtained without proper consent or authority.

4. Security and technical restrictions

You must not:

  • Attack or disrupt the Service — attempt to hack, gain unauthorised access to, interfere with, or disrupt the Service, its infrastructure, or other users — including denial-of-service or distributed-denial-of-service (DDoS) attacks.
  • Reverse-engineer or circumvent security — reverse-engineer, decompile, or attempt to derive source code, or bypass, disable, or interfere with any security, authentication, rate-limiting, or access-control measure.
  • Scrape or harvest data — use bots, crawlers, or other automated means to scrape, harvest, or extract data from the Service without our written permission.
  • Abuse the API or webhooks — make excessive, automated, or abusive use of our API or webhooks, or point a webhook at an internal address, a private network, or any other target intended to attack, overload, or abuse a system (including using the Service to relay requests to systems you are not authorised to reach).
  • Probe for vulnerabilities — scan, penetration-test, or probe the Service for vulnerabilities without our prior written authorisation. If you believe you have found a security issue, please report it responsibly (Section 8) rather than exploiting it.

5. Your obligations as a data controller

This section is specific to JIVIQ and important. When you use the chat widget, forms, booking, visitor tracking, or any other feature to collect data about your own customers, you are the data controller of that data and JIVIQ acts as your processor (this is explained in our Privacy Policy). That means the responsibility for handling your customers' personal data lawfully sits with you. In particular, you must:

  • Have a lawful basis for collecting and using the personal data you gather through JIVIQ (for example, consent or a legitimate business need), and only collect what you actually need.
  • Provide your own privacy notice to your end-users that explains how you use their data — including that you use JIVIQ to handle it. The in-product chat widget links to your privacy URL, so you must keep that URL current and accurate.
  • Not collect special-category (sensitive) data — such as health, biometric, religious, or similar data — through free-text fields (chat, notes, form answers) or anywhere else, unless you have your own lawful basis to do so and have taken the additional safeguards the law requires.
  • Honour your end-users' rights — respond to their access, correction, deletion, and objection requests as the controller. Where someone contacts JIVIQ directly about data you control, we will route the request to you and assist you in responding.

6. Content restrictions on public surfaces

Some JIVIQ surfaces are public-facing — booking pages, the chat widget on your website, and forms on forms.jiviq.com. You must not use these (or any other surface) to publish, host, or distribute:

  • adult or sexually explicit material, or content that sexualises minors;
  • illegal goods, services, or content;
  • hateful content, or content that promotes discrimination, harassment, or violence against people based on who they are;
  • content that is deceptive, that impersonates others, or that is designed to mislead the people who view it.

7. Enforcement

We would much rather help you fix a problem than shut you down. Where we can, we follow a graduated approach:

  • Warning — we notify you of the issue and ask you to correct it.
  • Content removal — we remove or disable access to the offending content.
  • Suspension — we temporarily suspend the account or a feature.
  • Termination — we close the account.

However, we may take any of these steps — including acting immediately and without prior notice — where it is necessary to protect the Service, other users, third parties, or to comply with the law (for example, in response to an active attack, illegal content, or a legal order). We may also report unlawful activity to the relevant authorities.

8. Reporting violations

If you become aware of a breach of this AUP — abusive content, a security vulnerability, phishing, impersonation, or any other misuse of the Service — please report it to support@jiviq.com with as much detail as you can, including the relevant URL, account, message, or file, and a description of the problem. This helps us investigate and act quickly.

9. Consequences of violations

Breaking this AUP can lead to removal of content, suspension or termination of your account, and loss of access to your data within the Service. It may also expose you to liability under our Terms of Service — including your obligations to indemnify JIVIQ — and under applicable law. Where you act as a data controller (Section 5), a failure to handle your customers' data lawfully is your responsibility, not JIVIQ's.

10. Changes to this policy

We may update this Acceptable Use Policy from time to time as the Service evolves or the law changes. Material changes will be announced by email or in-product notice. Your continued use of the Service after a change takes effect means you accept the updated policy.
