Terms of Service

These Terms of Service ("Terms") govern your use of jiviq ("the Service"). By creating an account or using the Service, you agree to these Terms. If you are agreeing on behalf of an organization, you represent that you have the authority to bind that organization.

1. The Service

jiviq provides scheduling, booking, and workspace tooling for service professionals. Specific features, limits, and pricing depend on the plan you select and may change from time to time. Material changes will be announced in advance.

2. Your account

  • You must provide accurate information and keep it up to date.
  • You are responsible for maintaining the confidentiality of your credentials.
  • You are responsible for all activity that occurs under your account.
  • You must be at least 16 years old to use the Service.

3. Acceptable use

You agree not to:

  • Use the Service for unlawful, harmful, or fraudulent purposes.
  • Upload malicious code, attempt to breach security, or probe for vulnerabilities without written authorization.
  • Resell, sublicense, or white-label the Service without a written agreement.
  • Send spam, unsolicited bulk messages, or content that violates others' rights.
  • Scrape, reverse-engineer, or attempt to extract non-public data from the Service.

4. Your content

You retain ownership of the content you submit to the Service (client records, services, notes, etc.). You grant jiviq a limited, worldwide, royalty-free licence to host, process, transmit, and display that content solely to operate and improve the Service for you.

5. Payments

  • Paid plans are billed in advance on a monthly or annual cycle, depending on your selection.
  • Cancellations and refunds are governed by our Cancellation & Refund Policy, including a 7-day money-back guarantee on first subscriptions.
  • If a charge fails, we may suspend the account until payment is resolved.
  • Taxes, where applicable, are added at checkout.

6. Third-party services

The Service may integrate with third-party platforms (payment processors, calendars, email/SMS providers). Your use of those services is governed by their own terms, and we are not responsible for their acts or omissions.

7. Availability

We aim for high availability but do not guarantee that the Service will be uninterrupted or error-free. We may perform scheduled maintenance and will make reasonable efforts to give advance notice.

8. Suspension and termination

You may cancel your account at any time from the product. We may suspend or terminate your access if you breach these Terms, use the Service in a way that creates risk for us or other users, or fail to pay fees owed. On termination, you can export your data for a reasonable period before it is deleted.

9. Intellectual property

jiviq, the jiviq logo, and the software comprising the Service are our property. These Terms do not grant you any right to use our brands, logos, or marks except as needed to use the Service.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, jiviq will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold jiviq harmless from claims arising out of your content, your use of the Service in breach of these Terms, or your violation of applicable law or the rights of a third party.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email or in-product notice at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which jiviq is incorporated, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of that jurisdiction, subject to any mandatory consumer-protection rights in your country of residence.
